Terms of Use

This Site provides information about Blu Gnu Games and our projects, including descriptions of planned games and links to our crowdfunding campaign. The Site is informational only. It does not operate a store, accept payments, or deliver products. If and when we sell products through the Site, we will update the Terms of Use (“Terms”).

All content on the Site, including text, images, graphics, audio, video, page layouts, and code (collectively, the “Content”), and all trademarks and logos are owned or licensed by Blu Gnu. Except as permitted in these Terms, you may not copy, reproduce, distribute, modify, publicly display, or otherwise use any Content without prior permission. You are granted limited ability to view and print Content for personal, non-commercial use.

We aim to provide accurate information, but we can not guarantee that Content on the Site is always accurate, complete, or up to date. You should not rely on the Site as your only source of information. We may change the Content at any time without notice. It is your responsibility to check for updates.

The Site includes links to third-party websites. Those links are provided for convenience only. We do not control those websites and we are not responsible for their content, practices, or policies. Any transactions you do on a third-party are between you and them. Review their terms before you proceed.

The Site and Content are provided “as is.” To the fullest extent permitted by law, Blu Gnu disclaims all warranties, express or implied. We do not guarantee the Site will be error free, secure, or free of malicious code at all times.

Blu Gnu, its officers, directors, employees, licensors, agents, or service providers will not be liable for any indirect, incidental, consequential, special, or punitive damages arising related to your use of the Site, even if we were advised of the possibility of those damages. Where applicable laws limit such exclusion, our liability will be limited to the maximum permitted by law.

You agree to indemnify, defend, and hold Blu Gnu and its officers, directors, employees, agents, affiliates, and contractors harmless for any claims, damages, losses, liabilities, costs, and expenses (including attorneys’ fees) arising from your violation of these Terms.

We may terminate your access to the Site at any time for any reason, including suspected violation of the Terms. Termination does not affect rights or obligations that arose before termination.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted and the rest of the Terms will remain active.

These Terms are governed by the laws of the state of Washington without regard to conflict of law rules. Any dispute arising from these Terms will be resolved in state or federal court located in Washington. If your local laws give you different rights, those remain.

We may update these Terms from time to time. If we make changes, we will update the Effective date. Your use of the Site after changes are posted constitutes your acceptance of the revised Terms.
